These Terms of Use constitute a legally binding agreement between you and Migraide AI, Inc. and its affiliated entity MIGRAIDE AI LIMITED (collectively, “Migraide”). By accessing or using the Migraide platform, you confirm that you have read, understood, and agreed to these Terms in their entirety. If you do not agree, you must not use the platform. These Terms contain limitations of liability, a dispute resolution clause, and provisions governing chargebacks and refunds that materially affect your legal rights.

1. Introduction and Parties

1.1 About Migraide

Migraide is an AI-enabled visa application preparation platform operated by Migraide AI, Inc., a corporation incorporated under the laws of the State of Delaware, United States of America, with its registered office at 1209 Orange Street, Wilmington, DE 19801, United States of America (hereinafter, “Migraide,” “we,” “us,” or “our”).

Migraide is a technology-assisted service that prepares your visa application package — including completed forms, a personalised cover letter, travel itinerary, and document checklist — drawing exclusively and directly from information and documentation manually supplied by you, the user. The completed package is delivered to you for download; you review it and submit it yourself through the relevant official channels (such as VFS Global, TLScontact, or consulate portals).

Migraide does not submit applications to embassies, consulates, or government portals on your behalf. Our platform is a document preparation and automation tool only. We do not provide immigration advice, legal advice, eligibility assessments, or any form of professional consultancy. Migraide makes no representation, warranty, or guarantee regarding any visa outcome, immigration decision, application approval, processing timeline, or any determination made by any immigration authority or third party.

1.2 Scope of These Terms

These Terms of Use (“Terms”) govern your access to and use of Migraide's website at Migraide.com, all associated applications, application programming interfaces, software, tools, and services (collectively, the “Platform” or “Service”). These Terms apply to all users of the Platform globally. Where additional or different provisions apply by reason of your jurisdiction of residence, those provisions are set out in the relevant jurisdiction-specific sections and shall prevail over the general provisions to the extent of any inconsistency.

1.3 Acceptance of Terms

By creating an account on the Platform, accessing any feature of the Service, uploading any documentation, or making any payment in connection with the Service, you represent and warrant that:

  1. You are at least eighteen (18) years of age or the age of majority in your jurisdiction of residence, whichever is higher;
  2. You have the legal capacity and authority to enter into a binding agreement;
  3. You have read and understood these Terms in full; and
  4. You agree to be legally bound by these Terms. If you are accessing the Platform on behalf of a legal entity, you further represent that you have authority to bind that entity to these Terms.

2. Description of the Service

2.1 Core Service Functionality

The Platform provides users with an automated form-filling service. Upon successful onboarding and identity verification, the user provides Migraide with the personal data and documentary information required for a specified visa application. The Platform's AI-enabled system uses that information to automatically navigate to the relevant official immigration authority website and populate the applicable visa application form fields with the data supplied by the user. The completed form alongside relevant documents such as a cover letter are thereafter presented to the user for review. Submission of the completed form to the relevant immigration authority is performed exclusively by the user, at the user's sole discretion and initiative.

2.2 Scope and Limitations of the Service

The Service is expressly limited to the technical function of form population as described in clause 2.1. For the avoidance of doubt, Migraide does not and shall not:

  1. Assess, evaluate, determine, or provide any opinion regarding the user's eligibility for any visa, entry clearance, leave to remain, or immigration status;
  2. Provide immigration advice, legal advice, regulated immigration services, or any form of professional consultancy within the meaning of applicable immigration legislation in any jurisdiction;
  3. Recommend, validate, or optimise the substantive content of any visa application or any response to immigration authority questions;
  4. Interact with immigration authorities on the user's behalf or as the user's representative, agent, or legal representative in any capacity;
  5. Guarantee, represent, or warrant that any visa application populated by the Platform will be successful or will result in any particular immigration outcome;
  6. Submit any application, form, or document to any immigration authority; submission is performed solely and exclusively by the user.

Users are solely and wholly responsible for the accuracy, completeness, legality, and suitability of all information provided to the Platform and for reviewing all form content prior to submission. Migraide accepts no responsibility for any errors, omissions, or inaccuracies in the information provided by users.

2.3 AI-Enabled Processing

The Platform utilises artificial intelligence and automated processing technology to perform form-filling functions. Users acknowledge that the Platform operates without continuous human supervision during form population. Migraide implements quality assurance procedures and technical safeguards to maintain service accuracy, but users are expressly advised and required to review all auto-populated form content carefully and in full before submission. The fact that form fields have been automatically populated by the Platform does not constitute Migraide's endorsement, approval, or validation of the accuracy or completeness of the information contained therein.

2.4 No Legal or Immigration Advice

Migraide is not a regulated immigration adviser, solicitor, barrister, attorney, or any other category of regulated professional in any jurisdiction. Nothing in the Service, the Platform, any communication from Migraide, or any output generated by the Platform constitutes or should be construed as legal advice, immigration advice, or professional advice of any kind. Users who require immigration advice are strongly encouraged to consult a qualified and registered immigration adviser or solicitor in the relevant jurisdiction.


3. User Accounts and Onboarding

3.1 Account Registration

To access the Service, users are required to create an account on the Platform by providing accurate, current, and complete registration information, including full legal name, a valid email address, contact telephone number, and such other information as Migraide may require from time to time. Users are obligated to maintain and promptly update their registration information to ensure it remains accurate and current. Migraide reserves the right to suspend or terminate accounts where registration information is or becomes inaccurate, false, or misleading.

3.2 Identity Verification

As part of the onboarding process, Migraide collects and processes an image of the user's international passport for the sole purpose of verifying the user's identity prior to provision of the Service. By uploading a passport image, the user confirms that the document belongs to them, is genuine, is currently valid, and has not been altered or tampered with in any manner. The passport image is processed strictly as a static photographic image for identity verification purposes only. Migraide does not perform biometric analysis, facial recognition, biometric template extraction, or model training on passport images. 3.3 Account Security

Users are responsible for maintaining the confidentiality of their account login credentials and for all activity conducted through their account. Users must notify Migraide immediately at hi@migraide.com upon becoming aware of any actual or suspected unauthorised access to, or use of, their account. Migraide shall not be liable for any losses arising from the user's failure to maintain the security of their account credentials. We will never request passwords from users by email, telephone, or any other means of communication.

3.4 One Account Per User

Each individual user is permitted to maintain only one active account on the Platform at any given time. The creation or operation of multiple accounts by the same individual is prohibited and may result in the suspension or termination of all such accounts and the forfeiture of any sums paid in connection therewith, subject to the refund provisions set out in Section 6 of these Terms.


4. User Obligations and Prohibited Conduct

4.1 General Obligations

By using the Platform, each user undertakes and agrees that they will always:

  1. Provide accurate, truthful, complete, and up-to-date information to the Platform, including all personal data and documentary materials submitted in connection with any visa application;
  2. Review all form content auto-populated by the Platform carefully and in full prior to submission to any immigration authority;
  3. Use the Platform solely for lawful purposes and in compliance with all applicable laws, regulations, and official guidelines in the user's jurisdiction of residence and the jurisdiction of the relevant immigration authority;
  4. Retain full personal responsibility for the content, accuracy, and completeness of any visa application submitted to an immigration authority;
  5. Not upload or submit information belonging to any third party without that party's explicit and informed written consent;
  6. Cooperate with Migraide's reasonable requests for information in connection with account verification, compliance investigations, or dispute resolution.

4.2 Prohibited Use

Users are expressly prohibited from using the Platform in any of the following ways. Any breach constitutes a material breach of these Terms entitling Migraide to immediately suspend or terminate the user's account and, where applicable, report the matter to relevant authorities:

  1. Submitting false, misleading, fraudulent, or fabricated information, documentation, or identity materials;
  2. Using the Platform to make visa applications on behalf of third parties without those parties' explicit consent and without Migraide's prior written authorisation;
  3. Attempting to circumvent, reverse-engineer, decompile, disassemble, or otherwise interfere with any component of the Platform or its underlying technology;
  4. Using automated tools, bots, scripts, or other non-human means to access or interact with the Platform, except as expressly provided by Migraide's API terms;
  5. Uploading or submitting content that is defamatory, offensive, abusive, discriminatory, or otherwise unlawful;
  6. Attempting to gain unauthorised access to any part of the Platform, any other user's account, or any system or network associated with the Platform;
  7. Use of the Platform by immigration agents, consultants, or other third parties on behalf of multiple applicants, unless expressly authorised in writing by Migraide;
  8. Knowingly exploiting any technical vulnerability or error in the Platform for any purpose;
  9. Engaging in any conduct that could disrupt, overload, or impair the functionality of the Platform or its associated infrastructure.

5. Intellectual Property

5.1 Migraide's Intellectual Property

All intellectual property rights in and to the Platform — including without limitation the software, algorithms, artificial intelligence models, user interface designs, graphics, text, trademarks, logos, trade names, and all other materials forming part of the Platform (collectively, “Migraide IP”) — are and shall remain the exclusive property of Migraide AI, Inc. or their respective licensors. Nothing in these Terms constitutes a transfer, assignment, or licence of any intellectual property rights to the user except as expressly provided herein.

5.2 Limited Licence to Users

Subject to the user's compliance with these Terms and payment of all applicable fees, Migraide grants the user a limited, non-exclusive, non-transferable, revocable, personal licence to access and use the Platform solely for the user's own personal non-commercial visa application purposes in accordance with these Terms. This licence does not include any right to sublicense, reproduce, distribute, publicly display, create derivative works from, or otherwise exploit any part of Migraide's IP. The Platform is intended for individual use only. Use by immigration agents, consultants, or third parties on behalf of multiple applicants is prohibited unless expressly authorised in writing by Migraide.

5.3 User-Provided Content

Users retain all intellectual property rights in the personal data and materials they provide to the Platform. By uploading materials to the Platform, users grant Migraide a limited, non-exclusive, royalty-free licence to process, store, and use those materials solely for the purpose of providing the Service and as described in the Privacy Policy. Migraide shall not use user-provided content for any other purpose, including advertising, marketing, or model training, without the user's prior explicit consent.


6. Fees, Payment, Refunds, and Chargebacks

6.1 Service Fees

Access to certain features of the Platform is subject to the payment of fees as set out on the Platform's pricing page. All Service Fees are stated in the applicable currency at the time of purchase and are inclusive of applicable value added tax (VAT) or goods and services tax (GST) where required by law. Migraide reserves the right to amend its pricing at any time upon reasonable notice to users. Changes to pricing shall not affect orders already confirmed and paid for prior to the effective date of any price change.

6.2 Payment Terms

Service Fees are payable in advance and in full at the time of placing an order. Migraide accepts payment by credit card, debit card, and such other payment methods as are made available on the Platform from time to time. All transactions are processed through Migraide's designated third-party payment processor(s). Migraide does not store full payment card details; such information is processed and secured by the payment processor in accordance with applicable Payment Card Industry Data Security Standards (PCI-DSS).

6.3 Service Commencement and Consumer Acknowledgement

IMPORTANT — ALL CONSUMERS: By expressly requesting that Migraide begin performing the Service during the Cooling-Off Period, and by acknowledging this clause at checkout, you agree that you are requesting immediate commencement of the Service and you acknowledge that you will lose your right of withdrawal once the Service has been fully performed, pursuant to Regulation 36(2)(a) and (b) of the Consumer Contracts Regulations 2013 (UK); Article 16(a) of the EU Consumer Rights Directive (2011/83/EU); and equivalent consumer protection laws applicable in your jurisdiction.

If the Service is only partially performed during the Cooling-Off Period, you may be entitled to a proportionate refund as described in clause 6.5. At the point of payment, users are required to positively confirm that they (a) request immediate commencement of the Service; and (b) acknowledge the consequences for the right of withdrawal as stated above. This confirmation is recorded by Migraide and constitutes part of the contract between Migraide and the user.

6.4 Refund Policy — General

  1. Service not yet commenced: Users are entitled to a full refund upon written request to hi@migraide.com within fourteen (14) calendar days of payment.
  2. Service in progress: Migraide shall provide a proportionate refund reflecting the value of work not yet completed, at Migraide's reasonable assessment.
  3. Service fully performed: No refund shall be due, except where Migraide has failed to perform the Service to the required standard as described in clause 7.
  4. Service Fees are not refundable on the basis that an immigration application was unsuccessful, refused, delayed, or resulted in an outcome other than that anticipated by the user.

6.5 Proportionate Refunds

Where a proportionate refund is applicable, the amount refundable shall be calculated by reference to the proportion of the Service that remains unperformed at the time the refund request is made, as assessed in good faith by Migraide. Migraide shall process all valid refund requests within fourteen (14) business days of receipt. Refunds shall be made to the original payment method used at the time of purchase.

6.6 Chargebacks — Policy and Consequences

CHARGEBACK NOTICE: Initiating a chargeback or payment dispute without first exhausting Migraide's dispute resolution process constitutes a breach of these Terms and may result in immediate suspension of your account and all future access to the Platform. Migraide reserves the right to initiate criminal proceedings or make a report to the relevant authorities against a user that initiates a fraudulent or unjustified chargeback.

6.6.1 Mandatory Pre-Dispute Resolution

Before initiating any chargeback, payment dispute, or reversal request, users are required to first contact Migraide's support team at hi@migraide.com and allow Migraide a reasonable opportunity to investigate and resolve the issue. Migraide will acknowledge all complaints within two (2) business days and will endeavour to resolve all disputes within fourteen (14) business days. For the avoidance of doubt, nothing in this clause restricts any statutory right a user may have to dispute a transaction with their card issuer or payment provider under applicable consumer protection legislation.

6.6.2 Consequences of Unjustified Chargebacks

Where Migraide determines that a chargeback has been initiated without valid grounds, the following consequences may apply:

  1. Immediate suspension or permanent termination of the user's account;
  2. Referral to Migraide's legal representatives for recovery of the disputed amount together with any bank fees, processing charges, and reasonable legal costs;
  3. Reporting the matter to relevant fraud prevention databases and authorities where fraudulent conduct is suspected;
  4. Civil proceedings to recover the disputed amount and associated losses.

6.6.3 Evidence in Chargeback Disputes

Migraide retains records of all service delivery, user interactions, platform access logs, timestamps, and digital confirmations, including the user's confirmation of service commencement under clause 6.3. This evidence will be submitted to the relevant card scheme and payment processor in response to any chargeback claim.

6.6.4 Legitimate Chargebacks

Nothing in this clause 6.6 shall restrict any right a user has under mandatory consumer protection legislation in their jurisdiction of residence, including the right to pursue a chargeback where Migraide has engaged in fraudulent conduct or where Migraide has fundamentally failed to deliver the contracted Service. Statutory rights are not affected by this policy.

6.7 Global Consumer Rights

Migraide operates as a global platform and is committed to respecting the mandatory consumer protection rights of all users, regardless of their country of residence. Where specific provisions of applicable mandatory consumer protection law in a user's jurisdiction of residence are more favourable than those stated in these Terms, those provisions prevail.

7. Warranties and Service Standards

7.1 Migraide's Warranties to Consumers

Migraide warrants to consumers that the Service will be performed with reasonable skill and care in accordance with applicable law. To the extent required by applicable consumer protection legislation (including the Consumer Rights Act 2015 in the United Kingdom and the Digital Content Directive 2019/770/EU in the European Union), Migraide warrants that the digital service will conform to the contract and that Migraide will supply any updates necessary to keep the digital service in conformity with the contract during the period of supply.

7.2 Accuracy of Form Population

Migraide warrants that the Platform will populate visa application forms using the information provided by the user, accurately reflecting the same information in the designated form fields. Migraide does not warrant that the auto-populated form will be accepted by, or result in any particular decision from, any immigration authority. The accuracy of the underlying information is the user's sole responsibility.

7.3 Service Availability

Migraide will use reasonable commercial endeavours to maintain Platform availability but does not warrant uninterrupted, error-free, or disruption-free access. Temporary unavailability may result from scheduled maintenance, emergency repairs, third-party outages, legal or technical constraints, or events beyond Migraide's reasonable control. Where reasonably practicable, advance notice of planned maintenance will be provided.

7.4 Third-Party Website Dependency

The Service is dependent upon the availability, functionality, and accessibility of official immigration authority websites operated by third parties, including sovereign governments. Migraide has no control over such websites and accepts no liability for any disruption, change, error, or unavailability of third-party immigration websites. In the event that changes on an official immigration website render the Platform unable to perform the Service, Migraide will notify affected users as soon as reasonably practicable and will offer a full refund for any Service that could not be performed.

7.5 Disclaimer of Additional Warranties

Save as expressly stated in this clause 7 and to the maximum extent permitted by applicable law, Migraide excludes all implied warranties, representations, and conditions, whether arising by statute, common law, or otherwise. Nothing in this clause shall exclude any statutory rights that cannot be excluded under applicable consumer protection law.


8. Limitation of Liability

8.1 Matters Not Excluded

Nothing in these Terms shall limit or exclude Migraide's liability for: (a) personal injury caused by Migraide's negligence; (b) fraud or fraudulent misrepresentation by Migraide; (c) any liability that cannot lawfully be excluded under the Consumer Rights Act 2015 (UK), the EU Consumer Rights Directive, or any other mandatory applicable consumer protection legislation; or (d) any other liability the exclusion of which is not permitted under applicable law.

8.2 Limitation of Migraide's Liability to Consumers

Subject to clause 8.1, and to the maximum extent permitted by applicable law, Migraide's total aggregate liability to a user in respect of all claims arising out of or in connection with these Terms and the Service shall not exceed the total amount of Service Fees paid by that user to Migraide in respect of the specific service transaction giving rise to the claim.

8.3 Consequential Loss

Subject to clause 8.1, and to the maximum extent permitted by applicable law, Migraide shall not be liable to any user for any: (a) indirect, incidental, special, or consequential loss or damage; (b) loss of profit, revenue, business, or anticipated savings; (c) loss of visa application opportunity or immigration status; (d) losses arising from the decisions, acts, or omissions of any immigration authority; (e) penalties, fines, or costs imposed by any governmental or immigration authority; or (f) any other loss or damage not directly and solely caused by a breach of these Terms by Migraide.

8.4 User's Responsibility for Submission

Migraide expressly accepts no liability for any consequence, loss, damage, or adverse outcome arising from or in connection with the user's decision to submit any visa application to any immigration authority, the content of any visa application submitted, the user's failure to review auto-populated form content, or any inaccuracy in information provided by the user to the Platform.


9. Transparency, Disclosure, and AI Governance

9.1 AI System Disclosure

In accordance with applicable transparency requirements under the EU AI Act (Regulation (EU) 2024/1689) and relevant regulatory frameworks, Migraide discloses to users that the Platform employs an artificial intelligence system to perform its form-filling function. Users are interacting with an AI-enabled automated system, not a human. The AI system operates by processing user-provided information and automatically populating designated fields on official immigration websites. Users are informed of this before the Service is initiated and are reminded of this at each form-filling session.

9.2 Human Review Obligation

Users are expressly required to review all auto-populated form content before submission. The Platform will present the completed form to the user for review before any submission step is made available. By proceeding to submission, the user confirms that they have reviewed all auto-populated content, that they are satisfied with its accuracy and completeness, and that they take full responsibility for the content of the submitted application.

9.3 No Eligibility Determination

Users are informed and acknowledge that the Platform does not assess, evaluate, or express any view on the user's eligibility for any visa or immigration status. The Platform's AI system does not make any determination that produces legal effects or significantly affects the user's legal position. The auto-population of a form does not constitute any representation by Migraide that the user is eligible for the visa for which the application is being made.

9.4 AI Governance Compliance

Migraide is committed to operating the Platform in compliance with applicable AI governance frameworks, including the EU AI Act and relevant guidance issued by the UK Information Commissioner's Office (ICO) on AI and data protection. Migraide maintains internal AI governance documentation, risk assessments, and technical records in support of its regulatory compliance obligations.


10. Term, Suspension, and Termination

10.1 Duration

These Terms commence on the date on which the user first accepts them in accordance with clause 1.3 and shall continue in force for so long as the user maintains an active account on the Platform or continues to access the Service, whichever is the later.

10.2 Termination by User

Users may terminate their account and these Terms at any time by submitting a written account closure request to hi@migraide.com. Migraide will process account closure requests within ten (10) business days. Following account closure, personal data will be processed in accordance with Migraide's data retention policy as described in the Privacy Policy.

10.3 Suspension and Termination by Migraide

Migraide reserves the right to suspend or terminate a user's account and access to the Service at any time with or without notice in the following circumstances:

  1. The user has materially breached any provision of these Terms;
  2. The user has provided false, fraudulent, or misleading information in connection with registration, onboarding, or use of the Service;
  3. The user has initiated a chargeback in breach of clause 6.6;
  4. Migraide has reasonable grounds to believe that the user's use of the Platform constitutes or may constitute a violation of applicable law;
  5. Migraide is required to suspend or terminate access by law, court order, or regulatory direction.

10.4 Effect of Termination

Upon termination of these Terms for any reason, the user's licence to use the Platform shall immediately cease, and the user shall have no further right of access to the Platform. Clauses 5.1, 6.6, 7.5, 8, 11, 12, and 13 of these Terms shall survive termination and continue in full force and effect.


11. Dispute Resolution

11.1 Internal Complaints Process

Users who have a complaint about the Service should submit their complaint in writing to hi@migraide.com with the subject line “Formal Complaint.” Migraide will acknowledge all formal complaints within two (2) business days and will investigate and respond in full within fourteen (14) business days of acknowledgement.

11.2 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of laws principles, subject to the following qualifications:

  1. EU users retain the right to bring proceedings in the courts of the EU member state in which they are resident, and to benefit from mandatory consumer protection provisions of the law of that member state;
  2. UK users retain the right to bring proceedings in the courts of England and Wales or the relevant jurisdiction within the United Kingdom in which they are ordinarily resident;
  3. All other users may bring proceedings in the State of Delaware, or where permitted by applicable mandatory consumer protection law, in the courts of their jurisdiction of residence;
  4. Nothing in this clause shall deprive any consumer of the protection afforded by the mandatory provisions of the law of the country in which they habitually reside.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional terms and conditions applicable to specific features of the Platform, constitute the entire agreement between Migraide and the user in relation to the subject matter hereof and supersede all prior discussions, representations, negotiations, and agreements, whether oral or written.

12.2 Amendments

Migraide reserves the right to amend these Terms at any time. Where an amendment is material, Migraide will provide users with at least thirty (30) calendar days' advance notice by email and by prominent notice on the Platform. Continued use of the Platform following the effective date of any amendment shall constitute acceptance of the amended Terms.

12.3 Severability

If any provision of these Terms is held by a court or competent authority to be invalid, unenforceable, or illegal, such provision shall be deemed modified to the minimum extent necessary to make it valid, enforceable, and legal. If such modification is not possible, the relevant provision shall be deemed deleted without affecting the validity and enforceability of the remaining provisions.

12.4 Waiver

Any failure or delay by Migraide in exercising any right, power, or remedy under these Terms shall not constitute a waiver of that right, power, or remedy.

12.5 Assignment

Migraide may assign, transfer, charge, sub-contract, or otherwise deal with its rights and obligations under these Terms to any affiliate, successor entity, or acquirer of Migraide's business or assets, provided that such assignee assumes all obligations to users under these Terms. Users may not assign or transfer any rights or obligations under these Terms without Migraide's prior written consent.

12.6 Force Majeure

Migraide shall not be in breach of these Terms or liable for any delay or failure to perform any obligation to the extent that such delay or failure arises from any cause beyond Migraide's reasonable control, including without limitation acts of God, fire, flood, pandemic, war, civil disorder, governmental action or regulation, telecommunications or internet failure, or disruption to third-party services. Where a force majeure event affects Migraide's ability to perform the Service, Migraide will notify affected users as soon as reasonably practicable and will offer a full refund of prepaid Service Fees for services that have not been performed.

12.7 Third-Party Rights

These Terms are entered into between Migraide and the user only. Nothing in these Terms confers or purports to confer any right, benefit, or remedy upon any third party. The Contracts (Rights of Third Parties) Act 1999 (UK) shall not apply to these Terms.

12.8 Language

These Terms are made in the English language. Should Migraide provide a translation of these Terms for convenience, the English version shall prevail in the event of any inconsistency or conflict between the English version and any translation.

12.9 Communications

Migraide may communicate with users by email, through the Platform interface, or by such other means as may be notified to users from time to time. Notices sent by Migraide to the user's registered email address shall be deemed received twenty-four (24) hours after sending.


13. Jurisdiction-Specific Provisions

13.1 European Union Users

  1. Your statutory consumer rights under EU law, including under the Consumer Rights Directive (2011/83/EU), the Digital Content Directive (2019/770/EU), and the Unfair Contract Terms Directive (93/13/EEC), are not affected by these Terms;
  2. Queries regarding Migraide's EU GDPR compliance may be directed to privacy@migraide.com;
  3. You have the right to bring legal proceedings in the courts of the EU member state of your habitual residence, pursuant to mandatory EU consumer law;
  4. Migraide complies with applicable provisions of the EU AI Act (Regulation (EU) 2024/1689) and the EU Digital Services Act (Regulation (EU) 2022/2065).

13.2 United Kingdom Users

  1. Your statutory consumer rights under UK law, including under the Consumer Rights Act 2015, the Consumer Contracts Regulations 2013, and the Consumer Protection from Unfair Trading Regulations 2008, are not affected by these Terms;
  2. Migraide's UK representative for UK GDPR purposes can be contacted at chris@migraide.com. Migraide is registered with the Information Commissioner's Office under registration number ZC057604;
  3. You have the right to bring legal proceedings in the courts of the jurisdiction within the United Kingdom in which you are ordinarily resident;
  4. Migraide complies with the UK GDPR, the Data Protection Act 2018, and relevant AI governance guidance issued by the ICO.

13.3 United States Users

  1. California residents have rights under the CCPA/CPRA, including the right to know what personal information is collected, to request deletion, and to opt out of the sale of their personal information (Migraide does not sell personal information). Contact: privacy@migraide.com;
  2. Residents of Virginia, Colorado, Connecticut, Texas, and other US states with applicable state privacy laws may have additional rights. Migraide will respond to valid requests in accordance with applicable legal requirements;
  3. To the extent permitted by applicable law, unresolved disputes between US users and Migraide shall be resolved by binding arbitration administered by JAMS in accordance with its Comprehensive Arbitration Rules, seated in Wilmington, Delaware. This arbitration clause does not apply to consumers in jurisdictions where mandatory consumer protection law prohibits such clauses, including UK and EU consumers.

13.4 Canadian Users

  1. Your statutory consumer protection rights under applicable provincial and territorial legislation — including the Ontario Consumer Protection Act 2002, the British Columbia Business Practices and Consumer Protection Act 2004, the Quebec Consumer Protection Act, and equivalent statutes — are not affected by these Terms;
  2. Migraide processes personal data of Canadian users in compliance with PIPEDA 2000 and applicable provincial privacy legislation. Contact: privacy@migraide.com. Unresolved privacy complaints may be referred to the Office of the Privacy Commissioner of Canada at priv.gc.ca;
  3. Canadian consumers may report concerns to the Competition Bureau of Canada at competitionbureau.gc.ca.

13.5 Australian Users

  1. Your statutory rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), including consumer guarantees applicable to the supply of services, are not affected by these Terms;
  2. Migraide processes personal data of Australian users in compliance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Contact: privacy@migraide.com. Unresolved privacy complaints may be referred to the OAIC at oaic.gov.au;
  3. Australian consumers may report concerns to the ACCC at accc.gov.au.

14. Updates to These Terms

These Terms were last updated on 6 March 2026. Migraide will update these Terms as necessary to reflect changes to the Service, applicable law, or regulatory requirements. The current version of these Terms is always available at Migraide.com/terms. The version of the Terms in force at the time of a relevant transaction or event shall govern that transaction or event.
